PROSPECTIVE MARRIAGE VISA TO AUSTRALIA Subclass 300
The Prospective Marriage Visa is a family Visa that enables fiancé(e)s of Australian citizens, Australian permanent residents or eligible New Zealand citizens to apply to marry their Australian partner and then seek to remain permanently in Australia on the basis of that relationship.
Fiancé(e)s of Australian citizens or permanent residents can apply for the prospective marriage Visa which, if granted, will be valid for nine (9) months.
The applicant must enter Australia, marry their sponsor and apply for the spouse Visa all within this nine-month period. To be eligible to apply for a Prospective Marriage Visa you must demonstrate that you:
- have personally known, i.e. met with, the Australian sponsor physically; AND,
- are engaged to be married to the Australian sponsor in Australia; AND,
- will marry the Australian sponsor in Australia within the Visa period; AND,
- after marriage, intend to live together in a genuine spousal relationship; AND,
- will apply for the spouse Visa in Australia within the Visa period.
You are also required to satisfy certain health and character requirements in order to meet the Visa criteria.
You must apply for a Prospective Marriage from outside Australia and you must be outside Australia at the time the Visa is granted.
